NOTE这件事经常被低估。它不是装修问题,而是好几套法规叠加的问题。
第一关是用途地域。城市规划把土地划分为多个用途地域,部分住居专用地域对旅馆类用途有限制,先查这一条,不合适就没必要往下谈。
第二关是建筑用途变更。当涉及的部分超过一定规模时,需要办理用途变更的建筑确认申请,这时前面说的检查済証问题就会浮上来。
第三关是营业许可的路线选择。走旅馆业法的简易宿所许可,还是走住宅宿泊事业法(民泊新法),两条路的要求与限制完全不同:民泊新法有全年180天的营业上限,简易宿所没有这个上限,但对设施与消防的要求更高。
第四关是消防。自动火灾报知设备、诱导灯、内装限制等,往往是改造预算里最容易被漏掉的一块。
顺序很重要:先查用途地域和检查済証,再决定许可路线,最后才做设计。反过来做,很容易改到一半发现开不了业。
この話は過小評価されがちです。内装の問題ではなく、複数の法令が重なった問題だからです。
第一の関門は用途地域です。都市計画は土地を用途地域に区分しており、住居専用地域の一部では旅館系の用途に制限があります。まずここを確認し、適さないのであれば先へ進む必要はありません。
第二の関門は建築基準法上の用途変更です。対象部分が一定の規模を超える場合、用途変更の建築確認申請が必要になり、ここで先ほどの検査済証の問題が表に出てきます。
第三の関門は許可のルート選択です。旅館業法の簡易宿所営業でいくのか、住宅宿泊事業法(民泊新法)でいくのか。要件も制約もまったく異なります。民泊新法には年間180日の営業上限がありますが、簡易宿所にその上限はありません。そのかわり設備と消防の要求は高くなります。
第四の関門は消防です。自動火災報知設備、誘導灯、内装制限。改修予算のなかで最も見落とされやすい部分です。
順番が重要です。まず用途地域と検査済証を確認し、次に許可のルートを決め、設計はその後です。逆に進めると、工事の途中で営業できないと分かる事態になりかねません。
This gets underestimated. It is not a question of interior finishes; it is several bodies of law stacked on top of one another.
The first gate is zoning. City planning divides land into use zones, and some residential zones restrict hotel-type uses. Check this first — if the zone does not permit it, there is nothing further to discuss.
The second gate is change of use under the Building Standards Act. Once the area involved exceeds a certain size, a change-of-use confirmation is required, and this is where the completion-certificate question resurfaces.
The third gate is which licence you go for: a simple lodging licence under the Hotel Business Act, or the Private Lodging Business Act, the so-called minpaku law. The requirements and the restrictions differ completely. The minpaku route caps operation at 180 nights a year; the simple-lodging route has no such cap, but asks more of the building and its fire safety.
The fourth gate is fire safety: automatic alarm systems, guide lights, restrictions on interior materials. This is the part most often left out of a renovation budget.
Order matters. Check the zoning and the completion certificate first, then choose the licence route, and design last. Do it the other way round and you can find yourself halfway through construction discovering you cannot open.
